Rules for using 7Overlay

1. Scope and provider
These Terms govern the use of 7Overlay, a web service operated by vGregor at the address stated in the Imprint. They apply between the operator and every registered user. Any conflicting terms of a user do not apply unless expressly agreed.
2. Service
7Overlay provides tools for creating and operating stream overlays, counters, chat games and related integrations. The exact feature set may evolve. Third-party services such as Twitch, 7TV and StreamElements remain independent and may change or discontinue their APIs.
3. Account and access
Sign-in is performed through Twitch. You must keep access to your Twitch account secure and may not transfer your 7Overlay access to another person. You are responsible for activity performed through your account unless you promptly report unauthorised access.
4. Permitted use
You may use 7Overlay only lawfully and in accordance with third-party platform rules. In particular, you must not interfere with the service, bypass access controls, automate abusive requests, introduce malicious code, violate intellectual-property or personality rights, or use overlays and uploads for unlawful content.
5. User content and fonts
You retain your rights in text, configurations, images and font files you provide. You grant us the limited, non-exclusive right to store, process and deliver that content solely as needed to provide the requested service. You confirm that you have the rights and licences required for every uploaded font or other item. We may block or remove unlawful or technically harmful content.
6. Availability and changes
We aim to keep the service available but do not promise uninterrupted or error-free operation. Maintenance, security incidents and third-party outages may cause interruptions. We may change or discontinue features where reasonably necessary, taking users' legitimate interests into account.
7. Charges
Unless a feature is expressly identified as paid before an order is placed, use is free of charge. Any future paid offering will be subject to the price, term, cancellation information and mandatory consumer information presented during checkout.
8. Termination
You may stop using the service at any time. You may request deletion of your account and associated personal data by contacting us. We may suspend or terminate access for a material or repeated breach, a security risk, or where continued provision is unreasonable. Statutory rights remain unaffected.
9. Liability
We have unlimited liability for intent and gross negligence, injury to life, body or health, guarantees, fraudulent concealment and liability required by law. For slight negligence involving an essential contractual duty, liability is limited to foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory protections of the country in which you habitually reside remain unaffected. The statutory place of jurisdiction applies. If any provision is invalid, the remaining provisions remain effective.
